Terms of use
Last updated: 4 October 2026
These terms govern the use of the essa.digital website and describe how cooperation on a project with ESSA Digital (the company named above, “we”) is set up. The specific terms of each project — scope, price, timeline and payment — are set in a written proposal or contract, and they take precedence over these general terms.
1. What we do
We design and build websites and web systems on WordPress, Laravel and Laravel + Next.js, carry out technical audits of existing sites and provide technical support after launch. Our services are intended for businesses.
2. Information on the site is not an offer
The prices on the site are starting prices for the base scope of each solution. They are commercial information, not an offer within the meaning of Art. 66 of the Polish Civil Code. Unless stated otherwise, prices are in US dollars and exclude VAT and other taxes that may apply.
3. How cooperation starts
- You send a request through the form, by email or in WhatsApp.
- We clarify the task in a technical brief.
- We send a written proposal: scope of work, price, timeline and payment terms.
- Cooperation starts once you accept the proposal or we sign a contract.
4. Price and changes of scope
The price in the accepted proposal doesn’t change unless the scope does. If new work comes up during the project, we agree on it in writing beforehand, together with its effect on the price and timeline.
5. Payment
Payment follows the terms of the proposal — as a rule, an advance before work starts and the remaining amount after delivery. We issue an invoice for each payment.
6. Cancellation
If you cancel before work starts, we refund the advance in full. If work has already started, we keep the part of the advance that covers the work done and refund the rest. The exact terms for a project are set in its proposal or contract.
7. Code and intellectual property
- After full payment, the rights to the code created for your project and full access to its repository pass to you; the fields of use are specified in the contract.
- Third-party components — WordPress, Laravel, Next.js, open-source libraries, fonts, plugins — remain under their own licences.
- We may mention the project and show screenshots of it in our portfolio unless you tell us not to.
8. Support after launch
Depending on the solution, a project includes 1 to 6 months of technical support after launch: fixing defects in the work we delivered, security updates and advice on running the system. After that period, support can continue under a separate agreement.
9. What we need from you
Content, access to accounts and services, and feedback on time — the timeline depends on them. You confirm that you have the rights to the materials you give us (texts, images, logos, data).
10. Liability
- We work with professional care. Site speed (for example, a PageSpeed score) is a target we build for; the final result also depends on the content, third-party services and hosting chosen by the client.
- We are not liable for the operation of third-party services: hosting, payment providers, advertising platforms, messengers.
- In relations with businesses, our liability is limited to the amount paid for the project and doesn’t cover lost profits, unless the damage was caused intentionally.
11. Use of the site
The content of the site — texts, design, graphics — belongs to ESSA Digital and may not be copied without our consent. Please don’t use the form to send spam or unlawful content. We try to keep the site available but don’t guarantee uninterrupted operation.
12. Consumers
Our services are aimed at businesses. If you act as a consumer, nothing in these terms limits the rights mandatory consumer protection law gives you.
13. Governing law and disputes
These terms and cooperation with us are governed by Polish law. We try to resolve disputes through negotiation first; otherwise, disputes with businesses are resolved by the court competent for our registered office, and disputes with consumers — by the court competent under the law.
14. Changes and contact
We may update these terms; the current version is always on this page, with the date at the top. Projects already under way continue under the terms of their proposal or contract. Questions: [email protected]. How we handle personal data is described in the Privacy policy.
